Labor lawyers and human resource people: Can an employer require employees to participate in a drinking game?

A businessman friend demanded that she and other employees of the Company participate in a drinking game to see who could drink the most shots of alcohol in the shortest period of time. They said he would be penalized if they refused to participate: they give jobs to do shit in a day than the others – who agreed to participate – would give it a day extra holiday. My question: can a boss legally do this? (Incidentally, the game was out drinking, and a couple of people got sick. However, luckily, no one got in a drunk driving accident.) My question is not whether the boss should have done this (obviously you should not have!). My question is whether an employee can take action against the chief to demand to do so. My friend is a recovering alcoholic and has no religious objection to alcohol – it just did not want to get drunk and sick. Thanks for any help you can provide.

I worked in a law firm working for years as a sr. paralegal and I have never heard talk about that. Tell your friend to speak immediately with an employment lawyer. I could not even advise you on what possible reasons for this would fall under and who have never heard talk about such a thing and I've seen almost everything.
