What are the laws on the capture of shoplifters store employees?
I work at Lion Foods grocery store and see theft people all the time and never do anything ecxept go tell my boss then they have been at that time. What are the laws to stop someone physically? I do not want end with some kind of assault charges because I got in a fight with someone stealing beer – which as an employee I am legally authorized to do? I asked my superiors in the work of this and all mumbled and changed the subject
The laws in each state are different. You should pose this question to a lawyer in your area. Usually, a store owner has the right to protect his, her or their goods, including taking reasonable steps to stop shoplifters. That means you can take reasonable steps to arrest and detain the person until the authorities arrive. There are, however, many reasons to prevent the adoption of such measures, including policies and procedures that the employer has implemented. While they may appreciate that stop someone from stealing beer, could be dismissed for violating policies the company, especially if the person or if you get hurt and a lawsuit may follow. You would do well to find out what policies are with respect to arrest shoplifters and implement these guidelines, even if it means that you can not do more than they already are doing. Most supermarket chains have control specialists inventory, unless your work, you must give up the fight for them.
