Alcohol Beer Percent

What is the maximum allowed alcohol to be served as a beer "or" malt beverage "?
At 7-11 I realized they are selling a malt beverage called "Joose" which has 9% alcohol. At what point to stop being the beer and require a license liquor is necessary?
It really varies by state but most states allow one alcoholic drink beer as much as persuasion 12% ABV to be sold with little attention or resources. Anything above that is when you start getting some wonky tax, distribution and labeling laws. In Iowa, for example, anything above 5% must be purchased through the state liquor agency, along with drink orders, or Texas than random beers label as "Ale" (which btw is rather stupid since beer is something specific). There are still some states that although absolutely bar the sale of beer with an alcohol content exceeding 6% (I weep for them) as Alabama.
